​BOOKING CONDITIONS

  1. Prices are subject to change as per change in Government / Hotel / Airline policy without prior notice.

  2. Rates include only those items specified in your itinerary.

  3. Please note, the names of hotels or any other service mentioned above only indicate that our rates have been based on usage of these service. It is not to be construed that service is confirmed until and unless we convey the confirmations to you on receipt of your acceptance.

  4. In the event of any of the above-mentioned services not becoming available at the time of initiating the reservations, we shall book alternate service at a similar or next best available one and shall pass on the difference of rates (supplement/reduction whatever applicable) to you.

  5. In case on any currency fluctuations or amendment in local Government taxes, or any fuel hike, we reserve the right to adjust the tour price accordingly. The due increase or decrease will be communicated accordingly.

  6. Until such time as confirmation of services is received from TRUVI this is a proposal only and is subject to availability as no reservations have been made.

  7. Please note that rates may increase between time of booking, time of payment and the confirmation. Any costs incurred due to amendments will not be borne by TRUVI.

  8. The rates quoted are subject to change without prior warning, should there be any increases in Park Fees, Fuel, Sales Tax or VAT, third party services, or any other circumstances beyond our control in the regions featured in this quote/booking.

  9. All guests must take out comprehensive travel insurance covering them for personal effects, personal accident, medical and emergency travel expenses, cancellation and curtailment.

  10. TRUVI cannot be held responsible should airlines discontinue flights on certain routings or change scheduled timetables, resulting in missed connections etc. Should an amendment in a routing or itinerary be necessary we will re-quote you accordingly.

  11. Dietary Requirements: All dietary requirements can be catered for. When making your reservation, please advise us of any specific dietary requirements that you may have and these will be communicated through to the respective establishment.

  12. Gratuities: Tipping is at your discretion. However, we are able to assist you with the guidelines.

  13. TRUVI reserves the right to modify program itineraries, including arranged sightseeing, and substitute accommodations, including vessels and trains, at any time due to unforeseen circumstances or circumstances beyond its control. Every effort will be made to operate itineraries as planned, but alterations may occur after the final itinerary has been issued.

  14. TRUVI strongly recommends that the guests insure themselves against loss of deposit, cancellation charges, medical expenses and loss of personal possessions, and any other foreseeable loss or expense.

GENERAL TERMS & CONDITIONS

HOTEL CHECK-IN & CHECK-OUT TIME

  1. Hotel Check-In 14:00 hours, Check-out time 12:00 noon local time.

  2. Early check-in / late check-out is based on hotel availability cannot be guaranteed and are at the sole discretion of the hotel.

  3. Should you wish to have a guaranteed room ready for your immediate check-in upon arrival, it requires an additional room night to be confirmed. Please ask TRUVI for details and prices.

  4. Upgrades are typically available on request at individual hotels for an additional cost. Please ask TRUVI for details and prices.

  5. Specific requests such as adjacent or connecting rooms, bedding requests, smoking rooms and special dietary needs should be advised at time of booking. Please note that reasonable efforts will be made to secure special requests; however, they cannot be guaranteed.

 

ITINERARIES

  1. TRUVI reserves the right to modify program itineraries, including arranged sightseeing, other arrangements, and substitute accommodations, including vessels, aircraft and trains, at any time due to unforeseen circumstances or circumstances beyond TRUVI’s control.

  2. Reasonable efforts will be made to operate itineraries as planned, but alterations may occur after the final itinerary has been issued.

  3. All scheduled sightseeing has been confirmed in advance, but venues including wildlife reserves, museums and other points of interest can change their hours of operations at short notice. If this occurs, your guide will offer alternative arrangements.

AIR TRANSPORTATION

  1. International airfare (to the journey starting point and from the ending point) is not included in TRUVI program pricing.

  2. Some journeys require internal flights as specified in the itinerary. This airfare is typically not included and must be purchased from TRUVI in addition to the journey (unless stated otherwise).

  3. In the instance where charter flights are used and seating is limited, TRUVI reserves the right to substitute and confirm air reservations on an available alternative scheduled air flight. All internal air is based on economy class seating and is 100% non-refundable at time of final payment.

  4. All international and internal air quotes are subject to change until final payment has been received by TRUVI.

  5. Flight confirmation is based on availability. Air reservations cannot be confirmed until a passport copy is received by TRUVI.

  6. All air carriers are independent contractors and are not owned, managed, controlled or operated by TRUVI.

  7. Your airline ticket constitutes a contract between yourself and the airlines (and not TRUVI), even if purchased through TRUVI.

  8. TRUVI shall not be liable and does not assume responsibility for, or accept claims with regard to, seat assignments, name changes, schedule changes, flight changes and/or cancellations.

  9. Should you change or cancel your air transportation arrangements before or after your travel begins, all airline change and cancellation fees will apply.

BAGGAGE

  1. Porterage is not included unless stated otherwise

  2. Please note should your journey include internal/domestic or charter flights, your luggage allowance may be only 1 piece of baggage and weight/size restrictions and additional costs may apply.

  3. Details will be provided in your Pre-Travel Documentation.

  4. Baggage and personal effects are at the owner’s risk throughout the travel program, and TRUVI assumes no liability for lost or damaged baggage.

  5. Please check with your international carrier for other baggage restrictions and fees applicable to your international flights.

PRICES AND ARRANGEMENTS

  1. Quoted journey prices are depending on the request where indicated.

  2. Although not expected, published prices may be modified due to unexpected significant external factors not forecasted at the time of printing.

  3. TRUVI is under no obligation to give a breakdown in costs of any journey.

  4. Any modifications to a Tailor Made itinerary, including dates or number of people travelling, will require a revised proposal.

CHILD POLICY

  1. No minimum age is required unless noted on the itinerary and all children under age 18 must be accompanied by an adult.

  2. Note that some accommodations require that children below a certain age share a room with an adult.

  3. The parent or guardian travelling alone with a child is recommended to carry documentation that proves their relationship to the child (e.g., birth certificate) and evidence that they have permission to travel with the child (e.g., consent letter).

  4. Guests travelling with children who are not related are recommended to carry documentation which provides evidence they have permission to travel with the child.

  5. Guests are advised to check with the appropriate government authority to determine the necessary documents required for travel with children.

  6. TRUVI cannot be held responsible should the guest, child or any member of the travelling party be denied entry to a country due to noncompliance with a country’s requirements.

ACTIVITIES & CONDUCT

  1. TRUVI will require prior notice if any participant has any physical or other condition or disability that would prevent them from participating in activities of any journey and/or could create a hazard to himself or herself or to other members of the group.

  2. Specific journeys have conditions that may require a guest produce a doctor’s certificate to TRUVI prior to travel.

  3. TRUVI will make reasonable efforts to accommodate a disability-related request for accommodation.

  4. If TRUVI, in its sole discretion, is unable to properly accommodate the need of the person(s) concerned or believes that health and safety may be compromised, TRUVI reserves the right to refuse participation.

  5. The guest represents that neither he nor she nor anyone travelling with him or her has any physical or other condition or disability that could create a hazard to himself or herself or other members of the tour.

  6. TRUVI also reserves the right to remove from the trip, at the guest’s own expense, anyone whose physical condition or conduct negatively impacts the enjoyment of the other guests or disrupts the tour.

PASSPORTS AND VISAS

  1. It is the guest’s sole responsibility to obtain and have available when necessary, the appropriate valid travel documents.

  2. All guests are advised to check with the appropriate government authority to determine the necessary documents required for their travel.

  3. A valid passport is required for Indonesian citizens travelling to all international destinations.

  4. Passports must be valid for six (6) months after completion of your journey and should also have sufficient blank visa pages for entry and exit stamps.

  5. Many destinations require a visa for Indonesian citizens; this will be indicated in your Pre-Travel Documentation. Guest should contact the appropriate consular office for entry requirements pertaining to their journey.

  6. You may be refused boarding or disembarked from a plane, vessel or train without liability for refund, payment, compensation, or credit of any kind if you do not have proper documentation, and you will be subject to any fine or other costs incurred by TRUVI which result from improper documentation or noncompliance with applicable regulations.

  7. TRUVI shall not be responsible should any guest be denied entry to a country due to noncompliance with these requirements.

 

RESERVATION AND PAYMENT SCHEDULE

  1. Any payments made to TRUVI constitute your acceptance of the terms and conditions set out herein and in more specific pre-travel documentation, including the guest information form.

  2. TRUVI only accepts bank transfer

  3. Deposit per person required at time of booking: A travel designing fee deposit of $1,000 per person for Signature journeys and 25% of the program price for Tailor Made is required at the time of booking. Final payment is due 120 days prior to departure. If your reservation is made within 120 days of departure, the entire cost of the trip must be paid at the time of the request in order to secure confirmation. Additional deposits may be required for planes, vessels and trains, including private charters; select accommodations as noted in your proposal; exclusive private use of accommodations or venues; groups of 10 or more; or itineraries that fall over holiday or festival seasons. An additional nonrefundable permit fee is required at time of booking for journeys including Uganda and Rwanda.

CANCELLATION CHARGES

  1. Cancellations must be received in writing and will become effective on the date of receipt, fax or email.

  2. Cancellations received by TRUVI are subject to the following:

    1. CANCELLATION FEES
      Cancellation fees will varies depending on each partners terms & conditions. The guest agrees the sums referenced in the cancellation provisions above are not a penalty and represent a reasonable effort on behalf of TRUVI to establish its loss prospectively and represent liquidated damages. These include amongst other costs but not limited to fees charged by hotels and travel suppliers to TRUVI for cancelled bookings.

    2. CHANGES OF THE ITINERARY
      The guest will be responsible for any changes or cancellations made to the itinerary at their request or beyond their control, before or during travel, including expenses incurred due to a change, delay or cancellation of any flights.

    3. CANCELLATION CHARGES FOR INTERNAL AIR
      All internal air is 100% non-refundable at time of final payment (some exceptions may apply).

    4. CANCELLATION CHARGES FOR EXTRA SERVICES
      Additional hotel nights and other extra services booked in connection with TRUVI are subject to specific cancellation penalties. These will be provided at the time of booking and noted on the invoice.

    5. COVID-19 ACKNOWLEDGEMENT
      Guest must provide required health documentation for travel and agree to comply with all health protocols as directed by TRUVI staff during their journey. Noncompliance with these measures will result in not being able to travel or continue on the journey. Guest voluntarily assumes all risks and related expenses in the event that they or any member of their travelling party require testing or quarantine, become infected with COVID-19 or experience travel interruptions or delays.

    6. FORCE MAJEURE
      Force majeure means unusual and unforeseeable circumstances beyond TRUVI's control or the control of our suppliers, the consequence of which neither TRUVI, nor its suppliers, could avoid even with all due care, including, but not limited to, war or threat of war; riot; civil strife; terrorist activity (actual or threatened); industrial dispute; technical problems with transport, machinery or equipment; outages or power failures; natural or nuclear disaster; fire, flood, drought or adverse weather conditions; pandemics, epidemics or outbreaks of illness; and ice conditions in oceans and level of water in rivers.
      In the event of a cancellation or material alteration to the journey as a result of the circumstances as described in this clause, TRUVI may in its sole and absolute discretion:

      1. offer the guest(s) alternative travel arrangements or products of comparable standard as may be appropriate in the circumstances; or

      2. if alternative travel arrangements or products are not offered by TRUVI, TRUVI will provide a travel credit to the guest equal to the value of the trip less any sums TRUVI is not able to recover from any supplier.

TRUVI cannot assume responsibility for any other travel related costs included but not limited to air, insurance, visas and other travel arrangements, etc.

  1. CLAIMS AND REFUNDS
    TRUVI will not accept any liability for any claims and will not provide refunds except as may be specifically allowed herein.

PHOTOGRAPHY DURING TRAVEL

  1. TRUVI on site partners reserves the right to take photographs and video of guests during the operation of any program or part thereof and to use, re-use, publish, and republish their image, identity likeness, name, voice, interview, statements, video clips and sound recordings, and/or photographic portraits or pictures in which guest(s) may be included (an “Image”), for promotional purposes during the program and thereafter.

  2. By booking a program with TRUVI, guests acknowledge that TRUVI is the owner of the photographs and video and agree to allow their Image to be used in such photographs and videos, which may thereafter, be used by TRUVI.

  3. Guests who prefer that their images not be used must

    1. identify themselves to their Resident Tour Director at the beginning of their Journey; and

    2. notify their TRUVI Travel Consultant by email, not later than thirty (30) days following the end of the guest’s journey.

  4. In the event the guest fails to comply with both obligations, the guest shall not be exempt from this section. If such written notice is not timely provided, the guests, individually and on behalf of any minor child travelling with them, have granted unrestricted rights and permission for TRUVI to use the Images.

LIMITS ON TRUVI’S RESPONSIBILITY

  1. Neither TRUVI nor its affiliates or subsidiaries, nor any of their respective employees, shareholders, officers, directors, successors, representatives, agents and assigns (collectively the “TRUVI Parties”), owns or operates any entity which is to or does provide goods or services for your trip with the exception of a limited number of vehicles.

  2. TRUVI purchases transportation (by aircraft, coach, train, vessel or otherwise), hotel and other lodging accommodations, restaurant, ground handling and other services from various independent suppliers (including from time-to-time other affiliated TRUVI companies).

  3. All such persons and entities are independent contractors. As a result, the TRUVI Parties are not liable for any negligent or wilful act of any such person or entity or of any third person.

  4. In addition and without limitation, the TRUVI Parties are not responsible for any injury, financial or physical loss, death, inconvenience, delay or damage to personal property in connection with the provision of any goods or services whether resulting from but not limited to acts of God or force majeure, illness, disease, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labour activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of aircraft or other means of transportation or for failure of any transportation mechanism to arrive or depart on time.

  5. There are many inherent risks in adventure travel of the type involved here, which can lead to illness, injury, or even death. These risks are increased by the fact that these trips take place in remote locations, far from medical facilities. Guest assumes all such risks associated with participating in these trips.

  6. If you decide to participate in any activities including, but not limited to, any excursions involving animals, riding on animals, scuba diving, snorkelling, boating, hot air ballooning, helicopter flights, ziplining, high altitude treks, climbing, quad biking, parasailing, parachuting, kayaking, white-water rafting, jet boat rides, snowmobiling, primate tracking and any other activity which TRUVI considers to carry inherent risk of serious illness, injury or death (“Activities”), then you fully understand and acknowledge that Activities carry with them various inherent risks, including serious illness, injury or death and you take complete responsibility for your own health and safety and agree to assume all risks of injury, illness or death, whether foreseen or unforeseen, that may befall you as a result of participating in any Activities and agree to release the TRUVI Parties from any liability whatsoever related thereto.

  7. Further, as consideration for being permitted to participate in the Activities; you release the TRUVI Parties, whether known or unknown, from, and agree not to sue or make claim against the TRUVI Parties for, property damage, cancellation of any Activities for any reason, illness, negligent rescue operations or procedures, personal injury, or death arising out of your participation in the Activities, and any activity related thereto, including transportation to and from the site of the Activities, regardless of whether such property damage, illness, personal injury, or death results from the negligence of the TRUVI Parties and/or from any defect in equipment.

  8. You further agree to indemnify and hold the TRUVI Parties harmless with respect to any claim made against the TRUVI Parties by anyone else which

    1. related to your participation in any trip or any Activities, or

    2. which would be subject to the above release and covenant not to sue if you had made the claim directly yourself.

Upon receipt of notice of the assertion of a claim, the TRUVI Parties reserve the right to approve, or withdraw approval of, counsel, in its sole discretion.

TRAVEL ADVISORIES/WARNINGS

  1. It is the responsibility of the guest to become informed about the most current travel advisories and warnings by referring to their respective government agencies.

  2. In the event of an active government agency Travel Warning against travel to the specific destination location(s) of the trip, should the guest still choose to travel, notwithstanding any travel advisory, the guest assumes all risk of personal injury, death or property damage that may arise out of the events like those advised or warned against.

 

 

ARBITRATION AGREEMENT

  1. Any controversy or claim arising out of or relating to these Terms and Conditions, to the Limits on TRUVI’s Responsibility clause, to any TRUVI brochure, or to any information regarding any TRUVI journey, service or package, or to any TRUVI-related trip, activity, service or package, shall be settled in the first instance by binding arbitration before one (1) arbitrator in Tangerang, Banten

  2. Any party or their representative may appear for the arbitration by telephone or video conference.

  3. Each party shall bear its own fees, costs and expenses and an equal share of any arbitrator and administrative fees; however, the prevailing party shall be entitled to full recovery of all such costs and fees.

  4. Disputes shall be arbitrated on an individual basis, with there being no right or authority for any disputes to be arbitrated on a class action basis or in a purported representative capacity on behalf of the general public, other travel suppliers or other entities similarly situated.

AMENDMENTS

  1. TRUVI reserves the right to correct any errors or omissions in its published materials and to amend these Terms and Conditions at any time as the result of any material changes to legislation or regulation.

  2. All amended Terms and Conditions shall automatically be effective upon being posted by TRUVI to the website www.truvi-vs.com. Accordingly, guests should check the website www.truvi-vs.com prior to travel in order to ensure they are aware of any changes.
